Welcome to Kera Golden Empire. These Terms and Conditions (“Terms”) govern your access to and use of the website keragoldenempire.com (the “Site”) and your purchase of any products from us. Please read them carefully before using the Site or placing an order.

By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Refund & Cancellation Policy, and Delivery Policy, which are incorporated into these Terms by reference. If you do not agree, please do not use the Site.

2. Eligibility

To place an order on the Site you must be at least 18 years old, or use the Site under the supervision of a parent or legal guardian, and be capable of entering into a legally binding contract. By placing an order, you confirm that the information you provide is true, accurate, and complete.

3. Products

We sell perfumes and fragrance products. We make every effort to display our products accurately, including descriptions, fragrance notes, and images. However:

Colours and packaging may appear slightly different depending on your screen or device.
Product packaging may occasionally vary from images shown, for example when manufacturers update their designs.
Fragrance perception is subjective; scent descriptions are provided as a guide and are not a guarantee of how a fragrance will smell on your skin.

All products are subject to availability. We reserve the right to discontinue any product at any time.

4. Orders and Contract Formation

Placing an item in your cart does not reserve it. An order is only placed when you complete checkout and payment.
After you place an order, you will receive an order confirmation by email. This confirms we have received your order — it is not acceptance.
A contract between you and us is formed only when we confirm that your order has been processed and/or dispatched.
We reserve the right to refuse or cancel any order, for example where a product is out of stock, where there is a pricing or description error, or where we suspect fraud. If we cancel an order you have already paid for, we will issue a full refund.

5. Prices and Payment

All prices are displayed on the Site in the currency shown at checkout. Prices may change at any time, but changes will not affect orders already confirmed.
Prices do not include delivery charges, which are calculated and displayed at checkout before you pay (see our Delivery Policy).
For international orders, prices do not include customs duties, import taxes, or clearance fees, which are the customer’s responsibility.
Payment is processed securely through Paystack, our third-party payment provider. Accepted payment methods (such as debit/credit card, bank transfer, and USSD) are shown at checkout.
We do not store your card details. All payment data is handled by Paystack on PCI-DSS compliant infrastructure.
Your order will not be processed until payment has been received and confirmed.
In the event of an obvious pricing error, we are not obliged to sell at the incorrect price. We will contact you to either confirm the order at the correct price or cancel it with a full refund.

6. Delivery

We deliver within Nigeria and internationally. Delivery methods, timelines, and charges are set out in our Delivery Policy. Delivery timelines are estimates and may be affected by factors outside our control, such as courier delays, customs processing, weather, or public holidays. Risk in the products passes to you upon delivery to the address you provided.

7. Returns, Refunds, and Cancellations

Our returns and refund process, including timelines and conditions (for example, that perfumes must be unopened and sealed for hygiene reasons), is set out in our Refund & Cancellation Policy. Nothing in these Terms affects any rights you have under applicable consumer protection law, including the Federal Competition and Consumer Protection Act (FCCPA) in Nigeria.

8. Accounts

If you create an account on the Site, you are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately at [Support Email] if you suspect unauthorised use. We may suspend or close accounts used in breach of these Terms.

9. Acceptable Use

You agree not to:

Use the Site for any unlawful or fraudulent purpose
Place orders using false identities or unauthorised payment methods
Interfere with the Site’s security, attempt to gain unauthorised access, or introduce malicious code
Copy, scrape, or reproduce Site content for commercial purposes without our written consent

All content on the Site including the Kera Golden Empire name, logo, product descriptions, images, graphics, and site design — is owned by or licensed to us and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Site without our prior written permission, except for personal, non-commercial viewing.

11. Product Use and Safety

Perfumes are for external use only. Keep away from eyes, broken skin, open flames, and out of reach of children. Discontinue use if irritation occurs. It is your responsibility to review fragrance ingredients if you have known allergies or sensitivities; contact us before purchase if you need ingredient information.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law. Subject to that:

We are not liable for indirect or consequential losses, including loss of profits or data, arising from your use of the Site or products.
Our total liability to you in connection with any order shall not exceed the total amount you paid for that order.
We are not liable for delays or failures caused by events beyond our reasonable control (force majeure), including natural disasters, strikes, courier failures, customs delays, or network outages.

13. Indemnity

You agree to indemnify and hold Kera Golden Empire harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

14. Privacy

Your personal data is handled in accordance with our Privacy Policy, in line with the Nigeria Data Protection Act, 2023.

16. Severability and Waiver

These Terms are governed by the laws of the Federal Republic of Nigeria. We encourage you to contact us first with any complaint most issues can be resolved quickly and amicably. If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts of Nigeria. Nothing in this clause deprives you of mandatory consumer protections available in your country of residence.
